Cet alin\u00e9a promulgu\u00e9 pourrait servir de rampe de lancement au Community Land Trust en France, un principe selon lequel il serait plus avantageux d&rsquo;acheter un b\u00e2ti sans le foncier.<\/p>\n<h2>Le Community Land Trust, un concept antisp\u00e9culatif venu d&rsquo;Am\u00e9rique<\/h2>\n<p>Le Community Land Trust est une forme de propri\u00e9t\u00e9 fonci\u00e8re collective reposant son concept sur plusieurs mod\u00e8les. Lanc\u00e9e aux \u00c9tats-Unis dans les ann\u00e9es 60 pour estomper l&rsquo;in\u00e9galit\u00e9 sociale, cette notion permet d\u00e9sormais aux Am\u00e9ricains d&rsquo;acqu\u00e9rir un bien immobilier malgr\u00e9 des revenus modestes. Les prix au m\u00e8tre carr\u00e9 sont alors largement inf\u00e9rieurs au cours classique du march\u00e9. Dans l&rsquo;\u00c9tat du Vermont entre autres, les maisons individuelles se vendaient jusqu&rsquo;\u00e0 20\u00a0% moins cher. Le Community Land Trust est par ailleurs g\u00e9r\u00e9 par des organismes non marchands contr\u00f4l\u00e9s par des gestionnaires de propri\u00e9t\u00e9s. Chaque communaut\u00e9 est ainsi tenue d&rsquo;atteindre diff\u00e9rents objectifs allant de la revitalisation d&rsquo;un quartier \u00e0 la mise en valeur des terrains en zone semi-rurale.<\/p>\n<h2>Quand le Community Land Trust d\u00e9barque en France<\/h2>\n<p>Le Community Land Trust France voit le jour \u00e0 la mi-d\u00e9cembre 2013. Cette association regroupant des urbanistes de m\u00e9tier s\u2019adresse aux acheteurs aux revenus modestes \u00e0 mod\u00e9r\u00e9s. Ils souhaitent par-dessus tout d\u00e9mocratiser cette solution au logement dans les zones tendues de l&rsquo;Hexagone. Cette premi\u00e8re association rendue publique fait pourtant des \u00e9mules. D&rsquo;autres communaut\u00e9s se sont ainsi constitu\u00e9es. La loi ALUR sur laquelle les CLT en France adaptent leur concept propose qui plus est un cadre juridique assez souple en mati\u00e8re de production de logements et de bar\u00e8mes des loyers au foncier. Les acqu\u00e9reurs sont en effet tenus de payer une allocation mensuelle pour l&rsquo;occupation du terrain outre l&rsquo;achat du b\u00e2ti proprement dit.<\/p>\n<h2>Les inqui\u00e9tudes concernant le Community Land Trust en France<\/h2>\n<p>Le Community Land Trust arrive en France non sans r\u00e9serve de la part des observateurs et des experts de l&rsquo;immobilier. Ce syst\u00e8me est-il vraiment un avantage pour les particuliers\u00a0? Doit-on r\u00e9pondre \u00e0 des crit\u00e8res pr\u00e9d\u00e9finis pour pouvoir acheter une maison sans le terrain\u00a0? Telles sont une partie des questions qui se posent. Le CLT en France n&rsquo;est pourtant pas encore l\u00e9gif\u00e9r\u00e9 par un cadre l\u00e9gal et officiel. En \u00e9num\u00e9rer les conditions d&rsquo;obtention est donc trop t\u00f4t. D&rsquo;autres observateurs estiment qu&rsquo;un plafond de ressources pourrait par exemple \u00eatre impos\u00e9. Les acqu\u00e9reurs pourraient cependant b\u00e9n\u00e9ficier d&rsquo;aides \u00e0 l&rsquo;achat de logement similaires au pr\u00eat \u00e0 taux Z\u00e9ro.
